Hmar People’s Convention (Democratic) – HPC (D) strongly condemns the untoward and senseless act of the Officer-in-Charge of the 38th Assam Rifles, Parbung, a Captain in rank, for indiscriminately negating the ground rules of Suspension of Operation (SoO) in his conduct in the remote village of Sipuikawn in Tipaimukh constituency. </div>

The Government of Mizoram and the Hmar Peoples Convention (Democratic)- HPC (D)- had a political talks at Conference Hall, Tourist Lodge, Chaltlang, Aizawl, Mizoram on July 18, 2013. The Government of Mizoram side was led by Lalbiakzama, Joint Secretary to the Govt. of Mizoram (Home Department), Ramthlengliana, SP, CID (SB), Lalchungnunga, Addl. DC., Aizawl District, Lalhriatpuia, Deputy Secretary (Home), David H. Lalthangliana, OSD (Home), Laltanpuia Sailo, Inspector (Interpreter). <br />
<a name='more'></a>The HPC (D) delegates was led by LT Hmar, Working Chairman HPC(D), Lalchhanhima, Council Member HPC(D), Lalthalien (delegate), Joseph R. Hmar (delegate), Lalmuanpuia Punte (Spokesperson), Rohringa (delegate) and Lalremruata Varte (delegate).<br />
<br />
Lalbiakzama, designated team leader representing the Government of Mizoram presided the meeting. He welcomed and thanked the HPC(D) delegates for attending the dialogue and also appreciated the efforts of the HPC(D) in finding an amicable solution to the problems of the Hmar peoples in Mizoram.<br />
<br />
LT Hmar, Working Chairman, HPC(D) submitted the memorandum of the HPC(D) that was addressed to the Chief Minister of Mizoram. The same memorandum was also addressed to the Governor of Mizoram, the Union Home Minister and Joint Secretary (North East), Govt of India.<br />
<br />
The HPC(D) memorandum termed the July 27,1994 Memorandum of Settlement (MoS)/ Peace Accord that was signed between the Government of Mizoram and the Hmar Peoples Convention (HPC) a hollow political instrument; and not accepted by the HPC(D). Nineteen years after the signing of the MoS, it has proved to the world that the document holds no water and does not stand to fulfil the aspirations of the Hmar peoples to secure their political future.<br />
<br />
In pursuance of the unfinished agenda of the Hmar peoples, the HPC(D) is committed to find a lasting, dignified and acceptable political solution to the Hmar’s aspirations with the creation of Hmar Autonomous District Council in the state of Mizoram within the scope of the Sixth Schedule of the Indian Constitution. This will be of mutual benefit and based on the long-term interest of both the Sinlung originated Hmar peoples and the Government of Mizoram.<br />
<br />
The HPC(D) remain fully and firmly committed not to seek separation from Mizoram but rather seek to find a permanent solution to the protracted Hmar issue in Mizoram, which is compatible with the principles enshrined in the Constitution of India. The HPC(D) firmly believes that to protect Hmar identity, culture, tradition, language, land, resources and to enhance political development and democratic decentralization in Mizoram, the only pragmatic option lies in the creation of Hmar Autonomous District Council.<br />
<br />
HPC(D) advocates a long-term solution that addresses and ends the political marginalization suffered by the Hmar peoples in Mizoram. It also believes that no solution will lead to enduring peace if it is devoid of political justice and political will; and it would not be just if it does not promote and enhance the political aspirations of the Hmar peoples.<br />
<br />
The HPC(D) demands that the Union Government of India and the Government of Mizoram make sincere, committed and concerted efforts to fulfil the aspirations of the Hmar peoples. The unfinished agenda should be politically settled in accordance with the Constitution of India with the following objectives:<br />
<br />
1. To initiate tripartite dialogue involving the Government of India, Government of Mizoram and the Hmar Peoples Convention-Democratic (HPC-D) for the creation of Hmar Autonomous District Council within the state of Mizoram.<br />
<br />
2. To provide Constitutional safeguards and protection to the Autonomous body as under the Sixth Schedule of the Indian Constitution.<br />
<br />
In the course of the dialogue, the issue of further extension of Suspension of Operation (SoO) which is due to expire in July 2013 was raised by Team Leader representing the Government of Mizoram. The HPC (D) leaders firmly maintains its stand that any further extension of SoO should be intricately linked with fixation of definite timeline for political dialogue within the month of July, 2013. The talks met a stalemate as it was submitted by the HPC(D) delegates that the issue of further extension of SoO also require prior consultation and decision of the HPC (D) Council.<br />
<br />
The HPC (D) strongly felt that extension of SoO in Mizoram has no meaning if the prospect for a meaningful political dialogue is not put in place. The democratic interests and aspirations of the Hmar peoples should not de downplayed by a negligent and irresponsible delay tactics. The Hmars’ aspirations is to justly secure the Constitutional promises, which otherwise has marginalized us.<br />

Ground Rules for implementation of Suspension of Operation (SoO) between the Government of Mizoram and the Hmar People's Convention (Democratic) was signed by representatives of the Mizoram government and the Hmar People's Convention (Democratic) at the State Guest House, Aizawl (Mizoram) after an exchange of views to initiate a peace dialogue in the common interest of finding a permanent political solutions to the Hmar political issues in Mizoram. Modalities of peace talks was first held in Silchar (Assam) on December 13, 2012.<br />

The HPC(D) team was led by Pu Lalbeisei, Vice-Chairman of the HPC(D) and the Mizoram government by Pu Lalbiakzama, Joint Secretary, Home Department, Government of Mizoram.<br />
<br />
Both parties agreed and signed a 9 points Ground Rules for implementation of SoO between the Government of Mizoram and the Hmar People's Convention (Democratic) which initially will be for a period of 6 months effective from January 31, 2013 and which may be extended by mutual consent. The two parties also mutually agreed to hold at least 2 (two) rounds of peace talks for a political solution during the 6 months SoO period.<br />
<br />
It is the sincere desire of the HPC(D) that a “Hmar-Government of Mizoram Political Talks” would settle the protracted political problems of the Hmars in Mizoram and that the Government of Mizoram is open and honest to the political aspirations of the Hmar people in Mizoram.<br />
<br />
The commitment of the HPC(D) in seeking a permanent political solutions of the Hmar people within the State of Mizoram is clear and unambiguous. The HPC(D) firmly believes that the unfinished agenda of the Hmar people in Mizoram could be resolved through dialogue.<br />

After India gained independence, the Hmar peoples are fragmented by different political boundaries, without our consent, and are compelled to negotiate political marginalisation in their respective states – Assam, Manipur, Mizoram, Meghalaya and Tripura. This historical and political subjugation has severely reduced our political entity, distancing us from securing our constitutional rights.<br />

he urgent need to realise our constitutional rights to redress our dignity as peoples has been the driving force behind the Hmar People’s Convention (Democratic) objective to demand for ‘Autonomous District Council’ for the Hmar peoples in Assam, Manipur and Mizoram under the Sixth Schedule of the Indian Constitution.<br />
<br />
In the pursuit of securing this end, the Hmar People’s Convention (Democratic) – Assam Region, has also initiated a political dialogue involving the Government of India and the Government of Assam after laying down arms by 56 cadres of HPC (D) which was hosted by the Government of Assam in the presence of the then Union Home Minister Shri. P. Chidambaram at Guwahati on 24th January, 2012. The first round of talks of the HPC (D) delegates – Government of Assam – the Central Government was held on 27th September, 2012.<br />
<br />
Similarly, since 1986, the Hmar People’s Convention (HPC) has been demanding for the creation of Hmar Autonomous District in Mizoram. In spite of the Peace Accord that was inked between the Government of Mizoram and the HPC, there was no concrete solution to address and redress the rights of the Hmar People. As a result, the HPC (D) has been continuous the same demand in Mizoram to redress the historical and political injustices. Acknowledging the matter, the Centre (Ministry of Home Affairs, Government of India) has been pressurising the Government of Mizoram to settle the political issues of the Hmars immediately. Following this and to pursue the unfinished agendas, the Government of Mizoram and the HPC (D) signed the Suspension of Operation (SoO) on November 11, 2010 for a period of six months. The SoO document was signed by Lalropui, Army Chief HPC (D) and the Home Secretary Shri. Lalmalsawma, Government of Mizoram.<br />
<br />
However, the Government of Mizoram failed to nurture the peace process with seriousness, which resulted in derailing the hard earned peace process. Taking note of this, the Centre (Ministry of Home Affairs) continued to pressurise the Government of Mizoram to settle the Hmar political problems. The government of Mizoram digressed from peaceful approach and acted untowardly when the HPC (D) on the other hand, is made to engage in finding the channels for political dialogue with All Party Leaders of Mizoram. While handing out the carrot, the Government of Mizoram arrested the HPC (D) Army Chief Shri. Lalropui and Deputy Army Chief Shri. Lalbiaknung from Silchar airport on 16th June, 2012 by the Mizoram Arm Police. Similarly HPC (D) Chairman Shri. Zosangber was again arrested from Delhi Airport by the MAP when he was on his way to meet officials of the Ministry of Home Affairs. The Government of Mizoram has severely failed to respect the peace process that has seemingly built.<br />
In the context of Manipur, the HPC (D) political interest is collectively shared with the United People’s Front (UPF), currently under SoO with the Government of India and the Government of Manipur. The UPF demands for an Autonomous Hill States within the state of Manipur. The HPC (D) did not sign the SoO documents in Manipur alone but as UPF, the document is collectively shared and signed along with the UPF members: KNF, KRA (U), UKLF, ZDV and ZRA. The HPC (D) has its designated Camp in Ankhasuo with ninety four (94) cadres enlisted. In Manipur, the HPC (D) will continue to abide by the goals shared within the UPF.<br />
<br />
The HPC (D) goals and objectives are independent in all its respective context and is free from the other. The SoO terms and conditions in Manipur, has no validity in other States. Therefore, the HPC (D) Manipur Region is not answerable for the HPC (D) of other regions/States as the HPC (D) Manipur Region is particularly confined in Manipur under UPF.<br />

For all time to come, the HPC (D) Manipur Region as signatory of SoO in Manipur cannot be made responsible or related to any acts of the HPC (D) of other regions.<br />

In the interests of peace, harmony and co-existence between indigenous communities in the district, the Hmar People's Convention (Democratic) appeals all to refrain from indulging in violence that could deteriorate conditions and incite communal hatred among different tribal communities in the hill district.<br />

The Executive Council of the Hmar People's Convention (Democratic) in its Emergency Meeting held on 29th September, 2011 collectively resolved and impeached Pu Lalhmingthang Sanate from the Party as well as his designation as President of the Party.<br />

<br />
Pu Lalhmingthang Sanate has severely failed to represent and uphold the interest of the Party and the aspiration of the Hmar peoples. After having convinced that the narrow selfish interest pursued by Pu Lalhmingthang Sanate stands against the Hmar People's Convention (Democratic) and the Hmar People that it represents, the Executive Council of the Hmar People's Convention (Democratic) is compelled to impeach him.<br />
<br />
Pu Lalhmingthang Sanate, without even informing and consulting the Executive Committee of the Hmar People's Convention (Democratic) signed the "DEED OF AGREEMENT" and merged the Hmar People's Convention (Democratic) as a member of the Kuki National Organisation (KNO). The Hmar People's Convention (Democratic) hereby declares that the "DEED OF AGREEMENT" signed by Pu Lalhmingthang Sanate is null and void. The Hmar People's Convention (Democratic) is convinced that the act of Pu Lalhmingthang Sanate is untoward, immature and undemocratic. The Hmar People's Convention (Democratic) sincerely apologise to the Hmar People for allowing a traitor to lead the Party and the People that it represent. However, with committed resolution in the interest of fulfilling the long-time political aspirations of Hmar People. The Hmar People's Convention (Democratic) is compelled to do the needful. The Hmar People's Convention (Democratic) believes that with this necessary reformation the Party and its vision will be put in the right direction. The Hmar People's Convention (Democratic) sincerely request the Hmar people to continue to pray for us and the goal that we collectively aspire for.<br />
<br />
From this day Pu Lalhmingthang Sanate should not take the name of Hmar or the Hmar People's Convention (Democratic) for any purpose. In the interest of the party that it represents and in the larger interest of peace, security and understanding, Pu Lalhmingthang Sanate must accept is serious mistake and his impeachment.<br />

<b>PRESS RELEASE</b><br />(June 27, 2011)<br /><br />Despite its repeated demarches and expressions of its seriousness for the “Hmar–Government of Mizoram Talks” to find a political solution to the Hmar issues in Mizoram, the Government of Mizoram has severely failed to uphold its commitment as it has not taken any perceptible step (a) to extend the Suspension of Operation (SoO) agreement and (b) to convey the date and venue for the talks as requested in writing by the HPC(D). While maintaining a stony silence on the official communique, some local, regional and as well as national newspapers, however, carried baseless and irresponsible statements from responsible authorities which were not only propagandistic but contained no element of truth.<a name='more'></a><br /><br />The wayward attitude of the Government of Mizoram has given the impression that it is keener in derailing the peace process than opening honourable democratic platform to work out a solution to the legitimate demands of the Hmar people as enshrined in the Constitution. This attitude is in complete contrast with the stand of the HPC(D) which strongly believes in securing the constitutional rights of the Hmars in Mizoram and is committed to do the same by all means. The HPC(D) hereby reiterates that it will never allow anyone to extinguish or compromise the political aspirations of the Hmar people.<br /><br />In the absence of any proactive interests on the part of the Government of Mizoram in extending the SoO period as well as in the progress of the “Hmar-Government of Mizoram Talks”, the HPC(D), hereby, declares that the “Suspension of Operation” between the Government of Mizoram and the HPC(D) has no longer existed.<br /><br />If, however, the Government of Mizoram, realizing the need to uphold its constitutional responsibility, is willing to renew its commitment for talks, the HPC(D) stands to its commitment in finding a peaceful solution and will not stand on the way to the extension and redefining of the period of SoO. The HPC(D) wants people to know that while preparation for talks has been going on, talks have yet to start and the ball is in the court of the Government of Mizoram.<br /><br />The deplorable plights of the Hmar people in Mizoram will remain the legitimate concern of the HPC(D). The blank accord of 1994 is deceptive and some of the provisions are outside the jurisdiction of the Indian Constitution. The Accord is an insult to the Government of Mizoram as well as the affected people. The Government of Mizoram should immediately stop inflicting injustices through this sham accord. The 1994 Accord cannot define or fulfill the political aspirations of the Hmar people. That blank accord should be declared null and void.<br /><br />The HPC(D) will not stand silent in the face of (a) institutional injustices ceaselessly unleashed to murder Hmar culture, language and literature; (b) exploitation by people in power that marginalized their land, rivers and natural resources and deprived them of everything basic to their lives and existence; (c) sinister designs to displace them from their ancestral land by damming their rivers and submerging their ancestral homes with offers of dirty compensation for their extinction; and (d) any attempt to wipe them off from the face of the earth.<br /><br />The collective leadership of the Sinlung Hills Development Council (SHDC) have resigned from March 4, 2011 in protest against the role of Mizoram Government (a) in forcing them to function as an interim Council for 15 long years (b) in exploiting the Council to create division among the Hmar people and (c) and for its failure to implement the provisions of the 1994 Accord, which, inter alia, provides for upgradation of the status of the Council to that of Autonomous District Council. It is a sad commentary that the Government of Mizoram has, knowingly and willfully, allowed itself to be a party to discriminate and exploit the Hmar people. Enough is enough. The Government of Mizoram should immediately stop using SHDC to blind and brand the Hmar people with all its manufactured negatives.<br /><br />The HPC(D) desires that no member of the Hmar tribe, or anyone, in any capacity, should, hereon, quest for the chair of the SHDC. Any individual or group(s) not heeding the wishes of HPC(D) shall be responsible for the damage and consequences that their misdeeds will cause to their own people and to themselves. It is time to learn to denounce the grave insult slung on the face of the people in SHDC.<br /><br />Despite the interplay of narrow and myopic interests in the run up of the talks, the HPC(D) firmly upholds the need for a democratic resolution to the Hmar political issues in Mizoram. At this critical juncture, the HPC(D) expects that, in the interest of the people of Mizoram in general and the people of SHDC in particular, the Government of Mizoram ought to bear its moral and political responsibilities to resolve the Hmar issues in Mizoram once and for all.<br /><br />Sd/-<br /><br /><b>(H. The Hmar Peoples’ Convention (Democratic) is deeply concerned with the strategic impediments the Government of Mizoram has purportedly been putting in the run-up of the Hmar-Government of Mizoram political talks by insisting new and narrow pre-conditions and interpretations in clear violation of the mutually agreed ground rules. HPC (D) considers the repeated attempts on the part of Government of Mizoram to dictate terms and conditions outside the purview of Suspension of Operation (SoO) Agreement as an attempt to sabotage the peace process and nip the prospect of a democratic dialogue in the bud.<br />
<a name='more'></a><br />
<br />
The HPC(D) has been earnestly reminding the Government of Mizoram to respect, adhere to and uphold the Suspension of Operation (SoO) agreement to all intents and purposes. However, the overblown pre-conditions set by it have not only betrayed the spirit and mutual trust but also seriously tarnished the credibility of the Government of Mizoram and its presumed seriousness for the talks. HPC (D) views and condemns the attitude of the Government as divisive and a sinister attempt to further thwart the political aspirations of the Hmar people.<br />
<br />
HPC(D) will not, in any manner, accommodate the divisive design of the Government of Mizoram. HPC(D) firmly reiterates its desire to open a dignified democratic platform to realize its political aspirations within the framework of the Constitution of India. HPC(D) also firmly holds that, in the interest of the nation as a whole and the marginalized Hmar people of Mizoram in particular, the Government of Mizoram and the HPC(D) ought to collectively work together, in the spirit of mutual trust, confidence and respect, to find a lasting solution to the political aspirations of the Hmar people in Mizoram.<br />
<br />
It is in pursuit of the stated HPC(D)’s policy and demand that talks have to be held, not to divide the country but to unite with a stronger bond by accommodating the marginalised interests of the Hmar people as enshrined in the Indian Constitution. To ensure successful deliberations, HPC(D) has advocated the necessity of signing Suspension of Operation (SoO) agreement for building trust, confidence and goodwill so that the talks are held in a peaceful environment. This resulted in the signing of Suspension of Operation (SoO) which provides space for the preparation of ground works and for wider consultations for achieving lasting peace and solution. It is in the backdrop of this preparation that the HPC(D) has asked the Government of Mizoram to first extend the term of SoO and then let HPC(D) know the date convenient for the talks so that mutually agreed convenient date and place for the first talk could be worked out. Official reply from the Government of Mizoram to this démarche is still awaited. HPC(D) holds that any issue raised by the Government of Mizoram within or outside the purview of the SoO agreement is to be discussed and sorted out when talks are held and therefore, strongly condemns any unilateral statement in public or through the media in violation of the mutual understanding as irresponsible and immature.<br />
<br />
While saying that, the HPC(D) is surprised by the recent statement of Pu Lal Thanhawla, Chief Minister of Mizoram, and Pu Lalmalsawma, Secretary to the Government of Mizoram, who publicly announced their assumption that the HPC(D) was trying to rope in “Americans” to represent its side at the Hmar–Government of Mizoram talks. The HPC(D) has not, even once, revealed the names of its delegate for the incoming Hmar-Government of Mizoram talks. More importantly, the HPC(D) is fully aware of and sensitive to the constitutional proprieties and norms and has, at no time, any intention of engaging any foreigner to represent them at the Hmar-Government of Mizoram talks. The Government of Mizoram should banish such thoughts as a product of demonic calculations and stick to its commitment. The glorified statement contains no element of truth.<br />
<br />
Both the engaging parties ought to envision a balance and lasting political solution so as to secure the future of Mizoram. HPC(D)’s demand for a political solution of the Hmar people in Mizoram is within the power and prerogative of the Government of Mizoram to fulfill and implement within the Constitution of India. It is embedded in the agreement signed between the Government of Mizoram and HPC in 1994. It is a debt of work the Government of Mizoram has to fulfill in return for long. The HPC(D) strongly condemns any repetition of divisive prod to fragment the Hmar people and deprive them of realizing their Constitutional rights. It is the desire of the HPC(D) that the Government of Mizoram is honest with its commitment for the upcoming Hmar- Government of Mizoram talks.<br />

After much deliberations on the ongoing peace process, the Hmar People’s Convention (Democratic) – HPC(D) is convinced of the absence of confidence, trust and commitment despite signing the document for the Suspension of Operation (SoO). The narrow pre-conditions that has been repeatedly put forward by the Government of Mizoram has not only reduced the credibility of the Suspension of Operation (SoO) document, but also the parties that are involved in it.<br />
<br />
The HPC(D) strongly believe that both the engaging parties should pro-actively work to build confidence, trust and goodwill before the Hmar-Government of Mizoram political talk is put on track.<br />
<br />
Therefore, in the interest of securing a healthy climate for the political talk, the HPC(D) opines that the current term of the SoO be fruitfully employed by both sides. Accordingly, it is the stand of the HPC(D) that the ‘Hmar-Government of Mizoram Political Talk’ be held only after the extension of the current term of the SoO.<br />
<br />
To pursue the matter, the HPC(D) will send its delegates for extending the SoO anytime in May, 2011. The Government of Mizoram may kindly find a date for the purpose.<br />

<b>Preamble</b><br />
<br />
<b>1.</b> The Government of Mizoram have been making earnest efforts to bring about an amicable solution to the problems arising out of the demands of the Hmar People’s Convention (HPC).<br />
<a name='more'></a><br />
<br />
<b>2.</b> Towards this end, an initiative was taken by the Government of Mizoram and a series of Peace Talks were held with the HPC leaders. Settlement on various issues reached during the course of the Talks are incorporated in the following paragraphs.<br />
<b><br /></b>
<b>Objective:</b><br />
<b><br /></b>
<b>3.</b> The main objective of the Memorandum of Settlement is to give adequate autonomy to the Sinlung Hills Development Council for social, economic, cultural and educational advancement of the people under the jurisdiction of the Council.<br />
<br />
<b>Restoration of Normalcy:</b><br />
<br />
<b>4.1</b> With a view to restoring peace and normalcy in Mizoram, the HPC on their part agree to undertake, within the agreed time-frame, all necessary steps to end all under-ground activities, to bring out all underground personnel of the HPC with their arms, ammunition and equipments to ensure their return to civil life, to abjure violence and help in the process of restoration of normalcy. The modalities of bringing out all underground personnel will be worked out. The implementation of the foregoing will be under the supervision of Government of Mizoram.<br />
<br />
<b>4.2</b> The HPC shall take immediate steps to amend, as may be necessary, its articles of Association/ Constitution so as to make them conform to the provisions of Law.<br />
<br />
<b>4.3</b> The Government of Mizoram will take steps for relief/ rehabilitation of all HPC underground personnel who had joined the HPC prior to 18th December, 1992, coming overground and ex-gratia will be paid to the next of kin/heirs/dependants of the HPC killed during the insurgency.<br />
<br />
<b>4.4</b> The HPC undertake not to extend any support to NSCN, ULFA and other such underground groups by supply of arms or providing protection or in any other manner.<br />
<br />
<b>ADMINISTRATIVE AND OTHER STEPS:</b><br />
<br />
<b>5.1</b> With a view to satisfying the desires and aspirations of Hmar community in Mizoram, the State Government will initiate measures for use of Hmar language as a medium of instruction upto Primary level and recognition of the Hmar language as one of the major languages of the State of Mizoram.<br />
<br />
<b>5.2</b> The Government of Mizoram will take steps for the promotion and preservation of Hmar culture and assistance may be provided as permissible under the rules by the Department of Art and Culture.<br />
<br />
<b>5.3</b> A new Civil Sub-Division will be opened at Sakawrdai and the Sub-Division Offices of different Departments will also be established at convenient locations in the area. The Primary Health Centre at Sakawrdai will also be upgraded into 30 bedded Community Health Centre.<br />
<br />
<b>5.4</b> For the social, economic, cultural and educational development of the people of the people in the north and north-eastern parts of Mizoram comprising an area to be specified and agreed upon by Government of Mizoram and HPC, Sinlung Hills Development Council will, by notification in the Office Gazette, be constituted by the Government of Mizoram and separate fund will be earmarked for schemes which may be specified for implementation within the area of the Council.<br />
<br />
<b>COMPOSITION OF THE COUNCIL:</b><br />
<b><br /></b>
<b>5.5</b> The composition of the Sinlung Hills Development Council during the interim period of 2 years shall be as follows:-<br />
<br />
1) President, Hmar People Convention - Chairman<br />
2) Any sitting MLA of the area (to be nominated by Govt.) - Vice Chairman<br />
3) 17 Nominated members from the area (14 members to be nominated by Chairman Of the Council and 3 members by the Govt.) - Members<br />
4) Representative of Finance Department - Member<br />
5)<span class="Apple-tab-span" style="white-space: pre;"> </span>All sitting MLAs of the area - Members<br />
6)<span class="Apple-tab-span" style="white-space: pre;"> </span>Representative of Planning Department - Member<br />
7)<span class="Apple-tab-span" style="white-space: pre;"> </span>Representative of Rural Development Department - Member<br />
8)<span class="Apple-tab-span" style="white-space: pre;"> </span>Deputy Commissioner concerned - Member<br />

<br />
<b>5.6</b> The headquarters of the Council shall, during the interim period of 2 years be Sakawrdai and it shall have a separate office with supporting staff. Permanent headquarters of the Council after the interim period shall be decided by the Government in consultation with the Interim Council. No salary or TA/DA will be admissible to the Vice Chairman and he will draw his salary and TA/DA as MLA from the Budget of the Mizoram Legislative Assembly. The other non-official members of the Council will be entitled to such allowances as are admissible to the non-official members of the State Planning Board.<br />
<br />
<b>5.7 </b>The Chairman of the Council will initially be the President, HPC, who will be provided with vehicle and residential quarters/bungalow and personal staff as determined by the Government. The Chairman will hold office for two years initially. Composition of the Council and the manner of nomination/election of the Chairman and members, after expiry of the interim period of two years, shall be decided by the Government in consultation with the Interim Council. The term of office of the Chairman and the Council shall be three years.<br />
<br />
<b>POWERS AND FUNCTIONS OF COUNCIL:</b><br />
<b><br /></b>
<b>5.8</b> The powers and functions of the Council will be indicated below:-<br />
<br />
1) To make plan out of earmarked fund. The plan will be implemented by the Department concerned. The plan made by the Council will be subject to the approval of the Government.<br />
2) To reallocate fund from one Scheme to another within the area and within the Sectoral allocation, provided that in case, the proposed new scheme is not identical in nature with the approved scheme, approval of the Government will be necessary;<br />
3) To draw up calendar of works for various Departments in the area and oversee their implementation;<br />
4) To make recommendation to the Government as deemed necessary in the interest of better planning, implementation and monitoring;<br />
5) To obtain information from any officer in the area regarding progress of plan schemes;<br />
6) To review the progress of the area plan once in a quarter; and<br />
7) Any other functions that the Government may allot from time to time.<br />
<br />
<b>FREQUENCY OF COUNCIL MEETING, ETC:</b><br />
<br />
<b>5.9</b> The Council shall meet at least once in three months. The Chairman will have the power to invite any two Government officials or non-officials, to attend any particular meeting of the Council, if considered necessary.<br />
<br />
<b>OTHER MATTERS:</b><br />
<b><br /></b>
<b>6.1</b> The Government of Mizoram have appreciated the concern and pressing demand of the HPC delegation, particularly regarding political safeguard as available under the Sixth Schedule to the Constitution of India. Accordingly the Government of Mizoram will take immediate measures for inclusion of an area to be specified within the HPC Demand Area of Mizoram and the other non-Schedule to the Constitution of India so that the above-mentioned areas are safeguarded under the Sixth Schedule to the Constitution of India.<br />
<br />
<b>6.2 </b>On fulfillment of the stipulations contained in Para 4.1, no member of the HPC now coming overground shall be prosecuted for offences committed in connection with underground activities. Investigation of all cases registered in Mizoram which are in progress currently against HPC personnel shall be dropped forthwith and those convicted of any such offence shall also be granted remission of sentences.<br />
